Terms of Service

1. Acceptance of Terms

By accessing or using Maejik, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the service.

2. Description of Service

Maejik is an AI-powered image and video generation service. You provide text prompts (and optionally reference images) and the service generates images or videos using third-party artificial intelligence models. The service operates on a credit-based system.

3. Accounts and Eligibility

You must be at least 18 years old to create an account and use Maejik. By registering, you confirm that you meet this age requirement. You are responsible for maintaining the security of your account and for all activity that occurs under it, and you must provide accurate information when creating your account. If we become aware that an account belongs to a person under 18, we will suspend or terminate it.

4. Credits and Payments

Credits are purchased through Stripe and are non-refundable except where required by law. Purchased credits expire 180 days after purchase. Free trial credits granted on signup expire 30 days after signup. Oldest credits are consumed first. Each generation consumes credits as indicated at the time of generation. If a generation fails, the credits are automatically refunded to your account.

5. Content Ownership

You retain ownership of the prompts and reference images you submit and the images or videos generated from them. You may use generated content for any purpose, including commercial use, subject to the terms of the underlying AI providers disclosed in our Privacy Policy. You are solely responsible for ensuring you have the rights to any reference images you upload and that your use of generated content complies with applicable laws.

6. Nature of AI-Generated Content

Outputs are produced by third-party AI models and may contain inaccuracies, visual artifacts, unintended resemblances to real people or copyrighted works, or otherwise unexpected results. Maejik does not verify the accuracy, originality, or suitability of generated content for any purpose. You are responsible for reviewing each output before using or publishing it, and for confirming it is fit for your intended use. Generated content is not a substitute for professional advice (legal, medical, financial, or otherwise).

7. Acceptable Use

You agree not to use Maejik to generate, upload, or distribute:

• Content that is illegal, abusive, or harmful under the laws that apply to you or to us.
• Sexual or nude content depicting real, identifiable people without their clear, informed consent, including non-consensual intimate imagery and sexual “deepfakes”.
• Any content that sexualises minors, or that depicts minors in a sexual, suggestive, or exploitative manner (CSAM). This is a zero-tolerance violation and we will report it to the relevant authorities.
• Content that impersonates a real, identifiable person (including public figures) without their consent, or that is designed to be mistaken for a genuine photograph, video, or statement of that person.
• Content designed to deceive or defraud others, including synthetic media intended to manipulate elections, political processes, financial markets, or to facilitate scams.
• Content that promotes, glorifies, or incites violence, terrorism, violent extremism, self-harm, or hatred against a protected group.
• Content that infringes the intellectual property, publicity, or privacy rights of others.
• Malware, phishing pages, or content intended to harm the security of others' systems.

You also agree not to attempt to circumvent usage limits, safety filters, rate limits, or other security measures, and not to reverse-engineer, scrape, or otherwise interfere with the service or the models we use. Some of these restrictions also reflect the terms of our upstream AI providers, which we are required to pass through to you. We reserve the right to suspend, throttle, or terminate accounts that violate these terms, without refund of unused credits where permitted by law.

8. Service Availability

Maejik is provided "as is" without warranties of any kind. We do not guarantee uninterrupted or error-free operation. We may modify, suspend, or discontinue the service at any time.

9. Limitation of Liability

Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other law which cannot be excluded, restricted, or modified by agreement. Subject to that, to the maximum extent permitted by law, Maejik and its operators are not liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, and our total aggregate liability to you in any 12-month period will not exceed the amount you have paid us for credits in that period.

10. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Maejik and its operators from and against any claims, damages, losses, liabilities, and reasonable legal costs arising out of or related to: (a) your breach of these terms; (b) your misuse of the service, including any violation of section 7 (Acceptable Use); or (c) your infringement of any third party's intellectual property, publicity, or privacy rights through content you submit to or generate with the service.

11. Changes to Terms

We may update these terms from time to time. Continued use of the service after changes constitutes acceptance of the revised terms. Material changes will be communicated through the application or via email.

12. Governing Law and Jurisdiction

These terms are governed by the laws of New South Wales, Australia, without regard to its conflict-of-laws principles. You and we submit to the exclusive jurisdiction of the courts of New South Wales, Australia and the courts competent to hear appeals from them, except that either party may seek injunctive relief in any court of competent jurisdiction to protect its intellectual property or confidential information.

13. General

Severability. If any provision of these terms is held to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.

Entire agreement. These terms, together with our Privacy Policy, constitute the entire agreement between you and Maejik in relation to the service and supersede any prior agreements, representations, or understandings (including anything communicated through marketing pages or support channels) on the same subject matter.

Assignment. You may not assign or transfer these terms or your account without our prior written consent. We may assign or transfer these terms, in whole or in part, without restriction, including in connection with a merger, acquisition, reorganisation, or sale of assets. Any assignment in breach of this clause is void.

No waiver. Our failure to enforce any right or provision of these terms will not be deemed a waiver of that right or provision.
